Food packaging: compliance-first selection

Selecting a hot-fill container resin by starting from EU 10/2011 and FDA requirements instead of mechanical properties — and why that order matters.

The brief

A food brand needed a reusable hot-fill container: filled at 85°C, microwave-reheatable, dishwasher-safe, transparent enough for retail display, and compliant for both the EU (Regulation 10/2011) and US (FDA 21 CFR) markets. The first instinct — pick a stiff, clear resin, then check compliance — is exactly backwards for food contact. Compliance must be the first filter, because a mechanically perfect resin that cannot produce a valid Declaration of Compliance (DoC) is unshippable.

The compliance filter

  • Positive-list check: the polymer and every additive (antioxidants, nucleators, clarifiers, colorants) must appear on EU 10/2011 Annex I or hold FDA clearance.
  • Overall migration limit (OML): 10 mg/dm² of material may transfer into food simulants under defined time/temperature conditions.
  • Specific migration limits (SML): individual substances — e.g. BPA — carry their own ceilings; some substances are simply not permitted.
  • Contact conditions: the intended use (fatty, acidic, aqueous food; hot-fill; repeated use) determines which simulants and test conditions apply.

PC was eliminated not by performance but by regulatory trajectory: with BPA migration limits tightening and retailers demanding BPA-free declarations, specifying PC in 2026 creates documentation risk that outlives the product. PP offered decades of migration data, easy DoC sourcing from major producers, and no substances under tightening review.

Engineering the PP to fit

Standard PP's weaknesses for this part were clarity and stiffness at temperature. A clarified random copolymer (PP-R with nucleating/clarifying package) closed the gap: haze below 15%, hot-fill distortion handled through rib design rather than a resin switch, and dishwasher cycling validated at 70°C over 250 cycles. The clarifier itself was positive-listed, which the supplier's DoC explicitly covered.

Verification steps

  • Collected supplier Declarations of Compliance for resin, masterbatch, and mold release policy.
  • Ran overall migration testing with simulants A (acetic acid), B (ethanol), and D2 (olive oil) at hot-fill conditions.
  • Documented full supply-chain traceability: lot-level resin certificates retained per production batch.

Outcome

  • Both EU and US compliance files approved with a single resin family.
  • Hot-fill and microwave testing passed on first submission after rib redesign.
  • Material cost ~40% below the PC baseline the brand originally assumed.

Takeaway: for food contact, selection order is compliance → processing → mechanics, never the reverse.
